The Merchandise described above is and shall at all times remain the sole and exclusive property of Kagan & Gaines Music Co., Inc.

In the event Kagan & Gaines has to take legal action to enforce pament and return of said property, the aboveshall pay to Kagan & Gaines - in addition to all other sums for which liable - all Kagan & Gaines costs for collection and attorney fees.

UNPAID BALANCE: Kagan & Gaines Music reserves the right to charge the credit card or debit card on file without notice to obtain payment for unpaid sums older than 15 days. If Kagan & Gaines is required to take such action, any deposit paid will be forfeited. Your signature on this Agreement, both electronic and handwritten, constitutes your full knowing consent in this matter. IT IS A CRIMINAL OFFENCE TO WITHOLD PROPERTY OF KAGAN & GAINES MUSIC WITHOUT PAYMENT AND WILL BE PERSUED WITH POLICE ACTION.

Covered by Maintenance & Repair (M&R) Fee: String replacement is not covered by the M&R fee. You ust purchase replacement strings. Theft and/or loss of instrument is not covered by the M&R fee. Customer will be responsible for the replacement cost of the instrument, less any accrued rental credit.

For Orchestra Rentals: Up to two years of rental credit paid (violins, violas, cellos, basses) can be applied toward the purchase; however, the rental credit to be applied cannot exceed 50% of the cost of the instrument.

For Band Rentals:

"RENT WITH OPTION TO BUY" AND RENTAL CREDIT: You may purchase your rented band instrument from Kagan & Gaines Music and are able to apply all of your rental payments (this is called Rental Credit) toward the purchase. Purchases using rental credit must me made during the rental term or within thirty (30) days of terminating the rental agreement. In addition, bufore rental credit can be applied, you must be current on all rental fees due. The rental credit does not include the M&R fee or any other item which was not rent. Rental credit is NOT cumulative (i.e. if a customer rents an allto saxophone, returns it after a year, and then decides to rent another saxophone a year later, the rental credit for the two rentals is NOT combined). Rental credit can be used only once, toward the purchase of one select instrument that is part of our rental program of the same or related instrument family. Rental credits unused after thirty (30) days of the end of the rental are forfeited. Rental credits have no cash value. *Note: Though you have the option to rent you band instrument until you own it, this is NOT a rent to own contract. Fretted instruments are limited to 1 year of rental credit that can be applied.

Taxes added where applicable. M&R fee is not applied toward purchase price.

All refunds will be pro-rated at monthly rates.
